RELEASE AND INDEMINIFICATION AGREEMENT
The undersigned indemnitor has requested permission to enter onto the The Maize at J Welch Farms (the property), located in Victoria County, Texas, which Is owned and/or operated by one or more of the following entities and individuals: J Welch Farms, LTD, Jackie Welch, JonAnn Welch.
The term “indemnitee” as used in this Agreement includes all of the owners of the Property, the owners' family members and the owners' partners, agents, employees, heirs, executors and assigns (if any, and specifically includes each of the above named persons and entities and their family members, partners, agents and employees).

THEREFORE, in consideration of the grant of permission to enter the Property, lndemnitor agrees as follows:
1. lndemnitor realizes that there are natural and man-made hazards on the Property, and lndernnitor assumes all risks in connection with such hazards. lndernnitor further agrees and understands that lndemnitee assume no liability for the safety of lndemnitor and/or for lndemnitor's property, and lndemnitor further agrees to release lndemnitee from any liability damages or injury to the person and/or property of lndemnitor occurring on the Property.
2. Cumulative of the foregoing, lndemnitor, for himself and his agents and employees, agrees to indemnify and hold lndemnitee harmless from any and all actions or causes of action, claims, demands, liabilities, loss, damage, injury, cost or expense of whatever kind or nature, including costs of litigation, attorney's fees and reasonable expenses in connection therewith, for injury to lndemnitor and/or for damage to or loss of property occurring on the Property, and regardless of whether such action, claim, demand, loss, injury or damage claim shall be valid or groundless.
3. The term “injury" as used herein also covers death; and this Agreement Is binding upon the estate of the lndemnitor. In addition to other matters covered thereby, the indemnification provisions of this Agreement also cover all claims for wrongful death under Section 71.001 et seq. of the Texas Civil Practice and Remedies Code.
4. lndemnitor expressly confirms that it is lndemnitor's intent that all indemnity obligations and liabilities assumed by the lndemnitor under the terms hereof shall be without monetary limit and that by executing this Agreement, lndemnitor expressly agrees to release and indemnify lndemnitee from and against the consequences of lndemnitee's own negligence (whether such negligence is active or passive and whether such negligence is the sole proximate cause or a proximate cause jointly and concurrently with the negligence of lndemnitor or others) resulting in the damages or injury to the person and/or property of lndemnitor covered by this Agreement.
5. lndemnitor further acknowledges and agrees that this Release and Indemnification Agreement is and shall remain effective for all entries onto the Property by lndemnitor, provided, however, this Agreement shall not be construed as a continuing license for lndemnitor to enter the Property, and lndemnitor acknowledges that lndemnitor shall enter the Property only at such times and places and for only such purposes which may be specified by lndemnitee.

AGREEMENT AND WARNING
I UNDERSTAND AND ACKNOWLEDGE THAT AN AGRITOURJSM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AGRITOURISM ACTIVITIES. I UNDERSTAND THAT I HAVE ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM AGRITOURISM ACTIVITIES.
I have read the foregoing agreement and I understand and freely agree to the terms hereof.
